These Terms of Service ("Terms") govern your use of the FlightPlus mobile application, website, and related services ("Services"). By creating an account or using the Services, you agree to these Terms.
1. Eligibility & Account Registration
You must be at least 13 years old (or the minimum age required in your jurisdiction) and capable of entering into a binding contract to use the Services. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Subscription Plans & Payments
FlightPlus offers a free Explorer tier and a paid Insighter tier ($4.99/month or $49.99/year) with a 7-day free trial. Subscriptions are purchased through Apple's in-app purchase system and are subject to Apple's terms and conditions. Prices are displayed in your local currency (converted from U.S. dollars) and may vary by region. Taxes may apply.
Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. You can manage or cancel your subscription through your Apple account settings. We may change subscription prices with advance notice; price changes will take effect in the next billing cycle.
3. User Content
3.1 Ownership
You retain ownership of all photos, captions, and other content you upload to FlightPlus ("User Content").
3.2 License
By uploading User Content, you grant FlightPlus a worldwide, non-exclusive, royalty-free license to host, store, display, modify, and distribute your content solely for the purpose of operating and improving the Services.
3.3 Public vs. Private Photos
Public Photos: Photos you mark as public are visible to all FlightPlus users, can be liked and viewed by others, and may be used by FlightPlus in future products, features, or marketing materials.
Private Photos: Photos you mark as private are only visible to you. FlightPlus will not use private photos for any purpose other than displaying them to you within the app.
3.4 Your Responsibilities
You represent and warrant that you have all necessary rights to upload User Content and that your content does not violate any laws, infringe on any third-party rights, or violate these Terms. You are solely responsible for your User Content.
4. Acceptable Use
You agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others (including intellectual property rights)
- Upload harmful, obscene, defamatory, or otherwise objectionable content
- Attempt to reverse engineer, interfere with, or overload the Services
- Use the Services for any commercial purpose without our written consent
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Collect or harvest information about other users without their consent
- Use automated systems (bots, scrapers) to access the Services
We reserve the right to remove content or suspend accounts that violate these rules.
5. Intellectual Property
FlightPlus and its licensors retain all rights, title, and interest in and to the Services, including all trademarks, logos, software, and content we provide. No rights are granted to you except as expressly set forth in these Terms.
6. Third-Party Services
The Services may integrate with third-party services (e.g., Firebase, Apple App Store, flight tracking APIs). Your use of third-party services is subject to their respective terms and conditions and privacy policies. We are not responsible for third-party services.
7. Termination & Account Deletion
7.1 Account Termination
You may delete your account at any time through the app's settings or by contacting us at info@flightplus.ai. We may suspend or terminate your access to the Services at any time, with or without cause, including for violations of these Terms or legal obligations. Upon termination, your license to use the Services ends, but sections of these Terms that by their nature should survive will remain in effect.
7.2 Immediate Data Deletion Upon Account Deletion
When you confirm account deletion in the app, FlightPlus will immediately and permanently delete the following data:
- Personal Profile Data: Your name, email address, profile photo, display name, and all other account information.
- Flight History: All flight records, including flight numbers, routes, dates, aircraft details, seat-side indicators, captions, hashtags, and journey notes.
- Private Aerial Photos: All photos you have marked as private, including associated metadata (timestamps, GPS coordinates, altitude, heading, and flight tracking data).
- Personal Trip Photos: All imported trip photos and their associated metadata (device timestamps, time-zone offsets, and flight linkages).
This deletion occurs immediately upon your confirmation and is permanent and irreversible. Once your account is deleted, we cannot recover any of your data. Please ensure you have exported or backed up any data you wish to retain before initiating account deletion.
7.3 Public Aerial Photos
Published public aerial photos will be deleted from FlightPlus upon account deletion. By publishing photos as public, you have granted FlightPlus a license to display and use those photos as described in Section 3.2. However, if any public photos have been incorporated into other products, services, or marketing materials prior to your account deletion, we will not trace or remove those instances. Your personal attribution (name, profile photo, and account association) will be removed from any remaining public photos upon account deletion.
7.4 Exceptions to Data Deletion
Notwithstanding the above, we may retain limited information as required by applicable law, to resolve disputes, enforce our agreements, or for legitimate business purposes such as fraud prevention and security. Any retained data will be anonymized or aggregated where possible and will not be used to identify you personally.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIGHTPLUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) USD $100 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY) OR (B) THE AMOUNT YOU PAID TO FLIGHTPLUS IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold FlightPlus, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or relating to your use of the Services, your User Content, or your violation of these Terms.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of Singapore, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Singapore for any disputes arising out of or relating to these Terms or the Services.
12. Changes to the Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or in-app notice. Your continued use of the Services after changes take effect means you agree to the revised Terms.
